  • Labor/delivery error : Birth injuries such as asphyxia, hypoxia, and death are sometimes caused by medical negligence. If a medical error occurs, it is usually a result of a failure to properly monitor the mother and baby.
  • Birth brain injuries : Newborns have incredibly fragile skulls, leaving them susceptible to brain injuries when medical equipment is used improperly.
  • Hypoxic Ischemic Encephalopathy : When a baby does not receive adequate oxygen, the child can suffer permanent, life-altering injuries. Hypoxic Ischemic Encephalopathy (HIE) is a medical condition that develops when a fetus or newborn receives an inadequate supply of oxygen resulting in damage to brain and spinal cord cells.
  • Cerebral palsy : A serious brain injury at birth can have life-altering consequences. Among other things, a brain injury can cause cerebral palsy, a neurological condition involving decreased neuromuscular and cognitive abilities.
  • Vacuum extractor or forceps injuries : Misuse of vacuum extractors or forceps during delivery can result in nerve or brain damage, skull fractures and cerebral palsy. Forceps misuse can also injure the mother, creating increased risk of lacerations, urinary tract infections and injuries to the rectum.

Medical Malpractice: Newborns and Children
